The Chapter 7 bankruptcy process takes a minimum of five months and includes:

  • Undergoing debt counseling
  • Attending a debt management course

Chapter 13 Bankruptcy

Debt readjustment is the focus of Chapter 13 bankruptcy, and is most often used as a remedy for someone to save their home from foreclosure. In this arrangement, individuals are required to make a monthly payment to a trustee for as long as five years, as well as using any extra income to take care of mortgage arrears.

Chapter 7 bankruptcy is often the most desirable route for clients, but not everyone qualifies. Chapter 13 provides an opportunity for those with household income above what is allowed for Chapter 7 to reorganize their debts and assets in an attempt to save that for which they have worked so hard.
